Rapper Kanye West is not going to just let this go.

On February 24, The Blast reported that his ex, Kim Kardashian, continued to push for her divorce from the “Donda” rapper. Kim petitioned for them to be legally separated, and Kanye objected to her petition. Kim continued to push by citing “emotional distress” in new documents, and Kanye is objecting to that too!

As The Blast previously reported, Kanye’s lawyers filed a motion to reject Kim’s petition to be declared legally single before their property and custody disputes could be resolved. Kim first asked the judge to declare her single back in December, even while Kanye made it known publicly that he was still trying to work things out.

Kanye’s lawyers are arguing that declaring Kim single may complicate the custody and property issues that the couple is currently facing. Kanye’s lawyers claim that if she remarries, she may move some of their shared assets to a personal account. Kanye’s attorneys say that there are three conditions that Kim would have to meet in order to be declared single.

First, if either of them dies, he wants to make sure any money that might be owing to either gets reimbursed. Second, Kanye wants to stop Kim from transferring assets out of any trust they created. Third, Kanye is requesting that Kim waive their marital privilege pending a final custody decision to ensure that any communication between them can be included as part of court records.

Kanye also added that if Kim does remarry, any spousal privileges between her and her new husband should be waived. However, Kim rejected all of these conditions.

Kim Continues To Push For Separation Based On Emotional Distress

In a recent update to the divorce drama, the SKIMS founder filed a new motion citing “emotional distress” as a reason for her to be legally declared single. In the documents, Kim writes, “I very much desire to be divorced.” She has said that her “emotional distress” results from the fact that she had asked Kanye to keep their divorce private, which is something that he has not done. Kanye has gone so far as to post private text messages between the pair on Instagram, although all of these text messages and private exchanges have all been deleted.

Although they have been deleted, they have all been well-documented and reported on by the Internet. Kim has cited these social media rants as a reason why they need to finalize the divorce independently. In the documents, Kim states, “Kanye has been putting a lot of misinformation regarding our private matters and co-parenting on social media which has created emotional distress.”

Part of the public co-parenting woes resulted after Kim created a TikTok account with North West. Kanye objected to the account, saying that it had been created without his permission and he did not want his child, a minor, on social media without his consent. He has also publicly accused Kim of preventing him from attending Chicago’s birthday party.

Despite Kanye’s frequent use of social media, there have been apparent issues in communicating with the rapper. In the documents, Kim cited an October 2021 message from Kanye’s lawyers that read, “But as you also know, we face challenges in communicating with our client — and the validity of the prenup (with all of its related legal implications) is a heavy issue to broach.”

Kim wrote, “While I wish our marriage would have succeeded, I have come to the realization that there is no way to repair our marriage. Kanye does not agree but at least it appears that he has come to the realization that I want to end our marriage, even if he does not.”

In documents obtained by The Blast, Kanye has again objected to Kim’s latest “emotional distress” filing.

In the documents, filed on Friday, February 25, Kanye’s lawyers insist that Kim’s claim that “Kanye West has been putting a lot of misinformation regarding our private family matters and co-parenting on social media” is “double hearsay.”

The document notes that “Kim claims she read something online allegedly by Kanye and characterizes the posts in her declaration as misinformation.” However, his lawyers noted that Kim did not actually attach any copies of the posts in her filing. His lawyers state that Kim did not enter these posts into evidence and that she needs to “show that the posts were written by Kanye.” Kanye is asking that her claims of “emotional distress” be stricken from the record without this supporting evidence.

The document continues to say “If good cause has been shown for an early and separate trial on the termination of marital status based on the declarations presented, then Kanye requests a trial date be set. That trial and any judgment following must be supported by admissible evidence, which does not include the declarations by Kim or her counsel. Kanye requests an order in limine that the declarations are considered for the limited purpose of determining if good cause exists for a separate trial.”

If a separate trial is held, Kanye “requests a statement of decision explaining the factual and legal basis for its decision regarding the termination” of their marriage.

Kim Kardashian has yet to respond to this latest objection to end their marriage.
