Olivier Martinez is suing the city of Los Angeles over a brutal motorcycle accident he claims caused him severe injury including a “brain injury.”
According to legal documents obtained by The Blast, the French actor filed a claim with the city for damages, demanding millions for the massive crash which he believes was caused by “multiple potholes.” However, the claim was denied, so he decided to sue in civil court.
Olivier Martinez Involved In Brutal Motorcycle Crash, Blames Government
Martinez accused the government of not properly maintaining the roads which resulted in him crashing his motorcycle on March 4, 2023. The “S.W.A.T” actor recalled that the brutal crash happened on Fairfax Ave., near 5th Street, in Los Angeles.
“Mr. Martinez was injured due to a dangerous condition of public property when the front tire of his motorcycle hit a large crack (about 6″ deep and 9″ wide) in the middle of the Roadway, causing the motorcycle to overturn, slide along the road, and throw Mr. Martinez onto the asphalt, in the middle of the roadway,” the filing reads.
The Paris native described the condition of the road as “dangerous due to damaged, deteriorated, worn out and crumbling asphalt, with multiple potholes, large/deep cracks,” adding that “a large/deep crack in the middle of two parallel concrete slabs which was not visible” was the main cause of the wreck.
Martinez alleged that the “large shadows of the nearby trees and lack of any warnings” made it impossible for him to spot the crack. The ex-husband of Halle Berry claimed that he suffered, “Concussion, Brain Injury, Loss of Consciousness, Facial Laceration, Nose Fracture, and further bodily injuries to be determined at a later time.”
The “Unfaithful” star demanded damages in the amount of $2 million from Los Angeles, claiming he has a unique Harley Davidson Motorcycle, which is most likely expensive.
He argued that the City had “notice of the dangerous condition for a long enough time to have protected against it and/or warned against it by posting appropriate signs and notices.”
Olivier Martinez & Halle Berry Settle Divorce After Years
Martinez’s lawsuit against the city comes five months after he and his ex-wife Halle Berry finally settled their contentious divorce after eight long years.
In court documents The Blast obtained, the “Catwoman” actress signed an agreement to settle ongoing issues with her ex-husband. “The parties have a written agreement that will be submitted to the court, or a stipulation for judgment will be submitted to the court and attached to Judgment,” it read.
However, the details of the settlement are private because Berry and Martinez agreed to settle their differences outside the court with a private judge in April 2023. The former couple who share a son announced their breakup after two years of marriage.
“We move forward with love and respect for one another and the shared focus of what is best for our son.”
The ex-couple’s divorce was plagued with drama as they battled over the custody of their son and disagreed on spousal support. In the actress’ filing, she asked for no spousal support for either party and claimed they had a prenuptial agreement that outlined the costs and payments associated with the support of their son.
As part of the divorce settlement, Martinez and Berry gained joint physical custody of Maceo. In addition, she will continue to pay for his education so long as he remains in private school.
The settlement document read, “In exercising joint legal custody, each Party shall consult and cooperate with the other to reach a mutual agreement with respect to issues affecting Maceo’s health, education, and welfare and neither Party shall make unilateral decisions impacting Maceo. Each Party shall keep the other Party informed of all matters pertaining to Maceo’s health and/or illness, education, and general welfare.”
The award-winning actress was given control over her son’s U.S. passport while Martinez Oliver was given control over his French passport. In terms of child support, the “John Wick” star was ordered to pay Oliver $8,000 per month. She also has to pay him 4.3% of any income she receives above $2,000,000, as and for additional child support for Maceo. The additional child support is to be paid in two equal installments by no later than December 1 of every year.
