MAGA influencer Ashley St. Clair filed two petitions on Friday against Elon Musk, seeking a court-ordered paternity test and sole custody of the 5-month old she says she and the SpaceX founder share.
Earlier this month, on Valentine’s Day, St. Clair posted a statement on Musk-owned social media platform X saying he was the father of her infant. The child would be Musk’s 13th, and his first with St. Clair.
Musk has not publicly acknowledged her claim, and an attorney for Musk named in the new filings did not immediately respond to a request for comment from HuffPost.
In the new petitions, filed in New York Supreme Court, St. Clair details her relationship with Musk. She alleges that the pair began their romantic relationship in May 2023, and conceived their son, identified in the filings as R.S.C, around January last year. News of the court filings was first broken by journalist Taylor Lorenz on her Substack, User Mag.
St. Clair claims in the filing that Musk has “acknowledged parentage of the child in various written correspondences” with her. Two images uploaded to the petition claim to show digital messages between St. Clair and Musk.
One message, dated Nov. 24, 2024, appears to show Musk telling St. Clair, “I want to knock you up again.” A second message, apparently from Musk on Feb. 2 of this year, reads, “Well, we do have a legion of kids to make.”

In a separate image of an alleged conversation between Musk and St. Clair included in St. Clair’s complaint, the two seem to discuss their child. Musk says he fears an assassination attempt and “if I make a mistake on security, R [the child] will never know his father.” St. Clair replies that that’s why their son has her surname and why no father is listed on the child’s birth certificate.

St. Clair claims in the petition that she and Musk previously agreed that she and the child would move to Austin, Texas after she gave birth. But around July last year, Musk “directed” St. Clair and the child to live in New York, where they currently reside, the filing claims.
In a separate filing, asking the court for sole custody, St. Clair paints Musk as an absent father, alleging she has been the sole parent and caretaker of their son. She claims Musk has only met their child three times and has had no involvement in his upbringing.
“I am the only parent who cares for him on a daily basis. I feed him, bathe him and ensure that all his physical and emotional needs are met,” St, Clair wrote. “By his choice, Respondent [Musk] was not present for the birth of our child, has had no more than three in-person visits with our child, and has not expressed an interest in having custody of our child.”
St. Clair alleges that Musk first met their son in September last year. During a visit to New York that month, he interacted with the child twice, according to the petition. While in New York, Musk only spent a total of three hours with the baby, St. Clair contends.
Musk saw R.S.C again in late November, when St. Clair and the infant were in Austin, Texas, according to the petition. During that visit, St. Clair said Musk only spent a total of 30 minutes with their son.

Since then, Musk has never asked to see his son again, St. Clair alleges in the petition. She claims Musk has never asked about the child, asked for photos of their son, or checked on his well being after doctor’s appointments.
Attorneys for St. Clair did not immediately respond to a request for comment from HuffPost. They wrote in their affirmation that their firm “has been dealing with” Musk’s legal representative in an attempt to resolve the matter privately, but that “his representatives have been nonresponsive in the past to resolve the outstanding issues.” The lawyers also stated that Musk “indicated that he no longer wishes to resolve issues of custody and support amicably.”
