The first-ever ‘Tool Live in the Sand’ destination festival wasn’t a chocolate chip trip for fans—some are considering a potential class action lawsuit. The reason? Fans were disappointed the setlists between the two nights were mostly the same.
Back to back performances on March 7 and March 8 were supposed to have a varied setlist for fans to enjoy, but four songs were repeated. “Fear Inoculum,” “Rosetta Stoned,” “Pneuma,” and “Jambi” were part of both nights. The three-day destination festival was held at the Hard Rock Hotel in Punta Cana, Dominican Republic. The high price to attend the event has left some concert goers feeling jilted.

Fans took to social media to share their disappointment that the set lists were not as different as they were promised. The law office of Stas Rusek is circulating a Facebook post suggesting fans who were supremely disappointed by the destination trip to contact them for potential representation in a class action lawsuit.
“Did you pay $4,000 – $10,000 for the Tool in the Sand Punta Cana festival with promises of two unique Tool performances?” the post begins. “You were promised two unique Tool setlists, you paid premium prices based on these promises, the second show repeated approximately 60% of the first night’s setlist, and the second performance ended early.”
“Our firm is investigating a potential class action lawsuit against the organizers of the Tool in the Sand festival for potential breach of contract and misrepresentation,” the post continues. They’re seeking anyone who attended the festival and purchased tickets and was unhappy with the performances. “Attorney Stas Rusek is not only a huge Tool fan, but also a festival attendee who feels your pain and seeks justice for all of those potentially ripped off by a classic bait and switch.”
So far, neither Tool nor frontman Maynard James Keenan have addressed the controversy. They’re busy moving on to Tool’s first Latin American headlining tour, hitting up Mexico City, Guadalajara, Buenos Aires, Santiago, Bogotá, and São Paulo.
